Regulations amending the regulations relating to fishing by vessels flying the russian flag in the economic zone of Norway and in the fisheries zone around Jan Mayen in 2009

On 30 June 2009, under sections 4 and 6 of the Act of 17 December 1976 No. 91 relating to the Economic Zone of Norway, cf section 13 of the Regulations of 13 May 1977 relating to fishing and hunting operations by foreign nationals in the Economic Zone of Norway, section 4 of the Royal Decree of 23 May 1980 No. 4 relating to the establishment of a fisheries zone around Jan Mayen, and the Ministry of Fisheries’ decision of 16 October 2000 concerning delegation of authority to adopt annual regulations after concluding quota agreements with other countries, the Directorate of Fisheries adopted the following regulations:

The following amendment is to be made to the Regulations of 16 December 2008 No. 1402 relating to fishing by vessels flying the Russian flag in the Economic Zone of Norway and in the fisheries zone around Jan Mayen in 2009:

Section 2, first paragraph, e (amended) shall read as follows:

Notwithstanding the prohibition of section 1, vessels flying the Russian flag are permitted to catch the following quantities of fish in the Economic Zone of Norway north of 62°N between 12 and 200 nautical miles from the baselines:

e) 2 500 tonnes redfish (Sebastes marinus and S. mentella) as a bycatch,

The amended regulations read as follows:

EGULATIONS RELATING TO FISHING BY VESSELS FLYING THE RUSSIAN FLAG IN THE ECONOMIC ZONE OF NORWAY AND IN THE FISHERIES ZONE AROUND JAN MAYEN IN 2009

On 16 December 2008, under sections 4 and 6 of Act of 17 December 1976 No. 91 relating to the Economic Zone of Norway, cf section 13 of the Regulations of 13 May 1977 relating to fishing and hunting operations by foreign nationals in the Economic Zone of Norway, section 4 of the Royal Decree of 23 May 1980 No. 4 relating to the establishment of a fisheries zone around Jan Mayen, and the Ministry of Fisheries’ decision of 16 October 2000 concerning delegation of authority to adopt annual regulations after concluding quota agreements with other countries, the Directorate of Fisheries adopted the following regulations:

CHAPTER I. GENERAL PROVISIONS

Section 1. General prohibition
It is prohibited for vessels flying the Russian flag to engage in fishing or hunting operations in the Economic Zone of Norway and in the fisheries zone around Jan Mayen between 12 and 200 nautical miles from the baselines.

CHAPTER 2. FISHING IN THE ECONOMIC ZONE OF NORWAY NORTH OF 62°N

Section 2. Quotas north of 62°N
Notwithstanding the prohibition of section 1, vessels flying the Russian flag are permitted to catch the following quantities of fish in the Economic Zone of Norway north of 62°N between 12 and 200 nautical miles from the baselines:

a) 140 000 tonnes North-East Arctic cod,
b) 20 000 tonnes North-East Arctic haddock,
c) 3 000 tonnes wolf-fish,
d) 15 000 tonnes saithe,
e) 2 500 tonnes redfish (Sebastes marinus and S. mentella) as a bycatch,
f) 210 633 tonnes Norwegian spring-spawning herring. This quota may also be fished in the fisheries zone around Jan Mayen,
g) 3 000 tonnes other fish species as a bycatch,
h) 152 000 tonnes capelin.

The Directorate of Fisheries may close the fishery when it is calculated that the quantities listed in a) to h) above have been caught.

Section 3. Fishing for saithe
Up to 7 000 tonnes of the saithe quota set out in section 2 d) may be taken when fishing specifically for saithe. The remaining quantity may only be taken as a bycatch during fishing operations for cod and haddock, and as a bycatch of up to 5% in each individual catch during fishing for herring.

Section 4. Bycatches of redfish
During fishing for other species it is permitted to take up to 15% by weight of redfish (Sebastes marinus and S. mentella) as a bycatch in each catch.

Section 5. Bycatches of Greenland halibut
During fishing for other species, a bycatch by weight of Greenland halibut of up to 7% is permitted at the end of fishing operations in the Economic Zone of Norway and in the catch landed. Nevertheless, a bycatch by weight of Greenland halibut of up to 12% is permitted in individual catches.

Section 6. Bycatches of other species
The quota of other fish species set out in section 2 g) applies only to species that are not subject to regulation by quotas, and may only be taken as a bycatch during fishing for species that are subject to regulation by quotas.

Section 7. Prohibition against fishing with large-meshed trawls and against fishing for greater argentine and blue whiting with small-meshed trawls
It is prohibited to fish with large-meshed trawls (135mm) and to fish for greater argentine and blue whiting with small-meshed trawls in the Economic Zone of Norway in an area delimited by straight lines through the following coordinates:

1. 66°30’N 06°59’E
2. 66°21’N 06°44’E
3. 65°43’N 06°00’E
4. 65°20’N 06°00’E
5. 65°20’N 05°30’E
6. 66°00’N 05°30’E
7. 66°30’N 06°34.27’E
8. 67°10’N 08°00’E
9. 67°10’N 08°35’E
10. 67°00’N 08°18’E
11. 66°50’N 08°09’E and from there a straight line to point 1.

It is prohibited to fish with large-meshed trawls (120 mm) and to fish for greater argentine and blue whiting with small-meshed trawls in the Economic Zone of Norway in an area delimited by straight lines through the following coordinates:

1. 62°36’N 03°00’E
2. 62°10’N 01°15’E (at the outer limit of the Economic Zone of Norway)
3. 62°40’N 00°52’E (at the outer limit of the Economic Zone of Norway)
4. 63°00’N 03°00’E and from there a straight line to position 1.

Section 8. Fishing for capelin
It is prohibited to fish capelin north of 74°N and in the Fisheries Protection Zone around Svalbard.

CHAPTER 3. FISHING FOR BLUE WHITING IN THE ECONOMIC ZONE OF NORWAY NORTH OF 62°N AND IN THE FISHERIES ZONE AROUND JAN MAYEN

Section 9. Quotas and restrictions on fishing areas
Notwithstanding the prohibition of section 1, vessels flying the Russian flag are permitted to catch 10 268 tonnes of blue whiting in an area in the Economic Zone of Norway and in the fisheries zone around Jan Mayen between 12 and 200 nautical miles from the baselines, west of straight lines drawn through the following coordinates:

1. 73°30’N 15°00’E
2. 73°00’N 14°40’E
3. 72°30’N 14°40’E
4. 71°45’N 15°10’E
5. 71°00’N 16°54’E
6. 70°14’N 16°58’E
7. 69°33’N 15°32’E
8. 69°09’N 13°37’E
9. 68°45’N 11°20’E
10. 67°40’N 09°27’E
11. 67°20’N 08°40’E
12. 67°05’N 08°00’E
13. 66°15’N 05°40’E
14. 64°10’N 05°40’E
15. 63°15’N 05°00’E
16. 62°40’N 03°00’E
17. 62°00’N 02°00’E

Section 10. Bycatches of mackerel
During fishing for blue whiting, a bycatch of mackerel of up to 10% by weight is permitted in individual catches.

CHAPTER 4. MISCELLANEOUS PROVISIONS

§ 11. Calculation of catch quantities
All catch quantities shall be calculated as live weight.

Section 12. Penalties and confiscation
Any person who wilfully or negligently contravenes provisions set out in or issued under these regulations is subject to a penalty and confiscation under sections 8 and 9 of the Act of 17 December 1976 No. 91 relating to the Economic Zone of Norway. Complicity or an attempt to contravene the said provisions is subject to the same penalty.

Section 13. Entry into force
These regulations enter into force on 1 January 2009 and apply up to and including 31 December 2009.
