Regulations amending the regulations relating to reporting for control by foreign vessels engaged in fishing in the Economic zone of Norway
On 30 May 2008, pursuant to sections 4 and 6 of the Act of 17 December 1976 No. 91 relating to the Economic Zone of Norway and section 8, litra f, of the Regulations of 13 May 1977 relating to fishing and hunting operations by foreign nationals in the Economic Zone of Norway, the Directorate of Fisheries laid down the following regulations:
I
The following amendments are to be made to the Regulations of 19 July 2005 relating to reporting for control by foreign vessels engaged in fishing in the Economic Zone of Norway:
Section 1, subsection 1, second paragraph (new), shall read as follows:
A foreign vessel that is engaged in fishing for Norwegian spring-spawning herring in the area north of 62o N and that stores fish on board in RSW tanks or in another way for delivery as fresh fish may in the period 1 October–28 February use the following temporary control point:

The current second to fifth paragraphs of section 1, subsection 1 become the new third to sixth paragraphs.

These regulations enter into force immediately.
The amended regulations read as follows:
REGULATIONS RELATING TO REPORTING FOR CONTROL BY FOREIGN VESSELS ENGAGED IN FISHING IN THE ECONOMIC ZONE OF NORWAY
On 19 July 2005, pursuant to sections 4 and 6 of the Act of 17 December 1976 No. 91 relating to the Economic Zone of Norway, cf Royal Decree of 5 December 1969 and section 8, litra g, of the Regulations of 13 May 1977 relating to fishing and hunting operations by foreign nationals in the Economic Zone of Norway, the Directorate of Fisheries laid down the following regulations:
§ 1Reporting on position for control
1. When a foreign vessel discontinues fishing operations in the Economic Zone of Norway north of 62o N, it shall report for control at one of the following control points:

A foreign vessel that is engaged in fishing for Norwegian spring-spawning herring in the area north of 62o N and that stores fish on board in RSW tanks or in another way for delivery as fresh fish may in the period 1 October–28 February use the following temporary control point:

The vessel shall report for control at the control point closest to the place where fishing operations are to be discontinued, and shall make contact with the Coast Guard on reaching the control point.
If the vessel alters or cancels its report on position for control, it must nevertheless report for control as stated in the original report unless otherwise agreed with the Coast Guard. A vessel that has sent an end of fishing report shall send a new start of fishing report before fishing operations may be resumed. When a new start of fishing report is sent, the time limits set out in section 8, litra a), of the Regulations relating to fishing and hunting operations by foreign nationals in the Economic Zone of Norway do not apply.
A vessel that is to land its catch in a Norwegian port after fishing in the Economic Zone of Norway shall give the port of landing instead of the control point in its report on position for control.
The report shall be sent to the Directorate of Fisheries at the latest 12 hours prior to arrival at the control point or port of landing. For vessels engaged in pelagic fishing operations and that store fish on board in RSW tanks or in another way for delivery as fresh fish, the corresponding time limit is four hours.
2. When a foreign vessel licensed to fish for mackerel in the Economic Zone of Norway discontinues fishing operations, it shall report for control in one of the following control areas:

3. 60° 30' N 03° 00' E
4. 61° 00' N 03° 00' E
2. An area delimited by straight lines between the following positions:

3. 58° 30' N 03° 00' E
4. 59° 00' N 03° 00' E
3. An area delimited by straight lines between the following positions:
1. 58° 00' N 07° 00' E
2. 57° 15' N 07° 00' E
3. 57° 35' N 08° 00' E
4. 58° 00' N 08° 00' E
The vessel shall make contact with the Coast Guard vessel in the area at the latest one hour before arrival at the stated position at the boundary of the control area. If direct contact cannot be made on VHF - MF/HF, the Coast Guard shall be called up via the coastal radio station.
A vessel that is to land its catch in a Norwegian port after fishing in the Economic Zone of Norway shall give the port of landing instead of the control point in its report on position for control.
The report shall be sent to the Directorate of Fisheries at the latest four hours prior to arrival at the control area or port of landing.
If the vessel is fishing in one of the control areas, the report shall be sent from this position.
During the period when foreign vessels are permitted to fish for mackerel in the Economic Zone of Norway, foreign vessels that are licensed to fish for herring south of 62o N shall also report for control as described in this provision.
§ 2 Content of the report
The report on position for control mentioned in section 1 shall contain the following information:

2 Mandatory for reporting for control in the areas mentioned in section 1, item 2
§ 3 Entry into force
These regulations enter into force immediately. From the same date, the Regulations of 11 October 1993 relating to the requirement for foreign vessels engaged in fishing and hunting operations in the Economic Zone of Norway north of 62o N to report for control and the Regulations of 19 July 1995 relating to the requirement for foreign vessels licensed to fish for mackerel in the Economic Zone of Norway to report for control are repealed.
