Regulatioins relating to registration of vessels that are to take part in shrimp fisheries in the Fisheries Protection Zone around Svalbard and the territorial and internal waters of Svalbard

 

As a result of the EU enlargement on 1 May 2004, when Estonia and Lithuania became EU Member States, the Director General of Fisheries has shortened the list of countries in the reference to the implementing Act and in section 1 of the Regulations of 11 July 1997 relating to registration of vessels that are to take part in shrimp fisheries in the fisheries protection zone around Svalbard and the territorial and internal waters of Svalbard, laid down by the Director General of Fisheries.

The regulations as amended read as follows:

REGULATIONS RELATING TO REGISTRATION OF VESSELS THAT ARE TO TAKE PART IN SHRIMP FISHERIES IN THE FISHERIES PROTECTION ZONE AROUND SVALBARD AND THE TERRITORIAL AND INTERNAL WATERS OF SVALBARD

On 11 July 1997, pursuant to section 2 of regulations issued on 19 July 1996 relating to fishing for shrimps using vessels of Canada, the Faeroe Islands, Greenland, Iceland, Member States of the EC and Norway in the fisheries protection zone around Svalbard and in the territorial and internal waters of Svalbard, and section 2 of regulations issued on 9 May 1997 relating to fishing for shrimps using vessels from Russia in the fisheries protection zone around Svalbard and in the territorial and internal waters of Svalbard, the Director General of Fisheries prescribed as follows:

§ 1 Scope
These regulations apply to Norwegian vessels with a permit to engage in shrimp trawling, and to vessels flying the Canadian, Greenland, Faeroese or Russian flag or the flag of a Member State of the EC that are to take part in shrimp fisheries in the fisheries protection zone around Svalbard and in the territorial and internal waters of Svalbard.

§ 2 Notification of registration
Any vessel that is to take part in fishing for shrimps in the waters mentioned in section 1 shall be registered in advance by means of a notification to the Directorate of Fisheries:

a)    before 1 January each year if possible, or
b)   well before departure from its home port, or
c)    not more than 30 days after the date on which a change takes effect if the information given in the notification changes.

The notification shall contain the following information:

1.    The vessel’s radio call sign and registration number
2.    The vessel’s name
3.    The type of notification: «REGISTRERINGSMELDING REKE SVALBARD»
4.    The vessel’s gross tonnage
5.    The type of vessel (gear type)
6.    The length of the vessel
7.    The vessel’s home port
8.    The name and address of the owner or charterer of the vessel.

§ 3 Replacement of a vessel
A vessel that has been registered to take part in the fishery pursuant to section 2 may be replaced by another registered vessel.

Notification of the replacement of one vessel by another must be sent to the Directorate of Fisheries before the replacement vessel commences fishing operations.

§ 4 Penal measures
Any wilful or negligent contravention of provisions set out in these regulations is subject to fines and confiscation pursuant to the provisions of sections 8 and 9 of the Act of 17 December 1976 No. 91 relating to the Economic Zone of Norway and to a penalty pursuant to section 4, second paragraph, of the Act of 17 July 1925 relating to Spitzbergen.

§ 5 Entry into force
These regulations enter into force immediately.
